1. Overview

This website is operated by Kilesh Company for the Manufacturing of Ready-Made Garments and Textiles, trading as Acacia ("Acacia," "we," "us," or "our"). Acacia operates https://acaciawear.com (the "Site") and offers clothing products, including cotton underwear, undershirts, and socks for men, women, and children, together with the information, features, customer support, and other services available through the Site (collectively, the "Services").

These Terms and Conditions (the "Terms") govern your access to the Site and your use of the Services, including any purchase made from Acacia. By accessing the Site, creating an account, or submitting an order, you agree to these Terms and to the policies incorporated into them by reference, including our Privacy Policy, Refund Policy, and Shipping Policy.

Please read these Terms carefully before using the Services. If you do not agree to them, you should not use the Site or submit an order. Nothing in these Terms limits or excludes any mandatory rights granted to you under applicable consumer-protection law.

2. Eligibility and Customer Accounts

You must be at least 18 years old or otherwise have the legal capacity to enter into a binding contract to place an order. If you are under 18, you may use the Site only with the involvement and authorization of a parent or legal guardian. Products intended for children must be purchased by an adult.

When creating an account or placing an order, you agree to provide accurate, current, and complete information. You are responsible for keeping your account credentials confidential and for activity carried out through your account, except where the activity results from Acacia's fault or a security incident outside your reasonable control.

Please notify us promptly if you believe your account has been accessed without authorization. We may suspend or restrict an account where reasonably necessary to protect customers, prevent fraud, comply with law, or address a material violation of these Terms.

3. Product Information and Availability

We make reasonable efforts to ensure that product descriptions, materials, sizes, colors, images, prices, and availability are accurate and up to date. Product images are provided for illustration. Colors may appear slightly different because of screen settings, lighting, photography, or reasonable manufacturing variation. Please review the product description and size guide before ordering.

A product described as "100% cotton" or with another specific fiber composition is offered according to the composition stated on the relevant product page and product label.

All products are subject to availability. Placing an item in your basket does not reserve it. We may limit quantities, withdraw a product, or restrict sales to particular locations where reasonably necessary, but we will not apply such restrictions unlawfully or discriminatorily.

Nothing in this section limits your rights if a product is defective, damaged, materially different from its description, or otherwise does not conform to applicable law or the confirmed order.

4. Prices, Taxes, and Payment

Prices may change at any time before an order is submitted. A price change will not affect an order that we have already accepted, except where required by law or where there is an obvious pricing error that you agree to correct.

The total amount payable, including applicable taxes and any delivery charges collected by Acacia, will be displayed before you submit your order. The available currencies and payment methods will be shown at checkout.

You confirm that you are authorized to use the payment method selected. Payment information may be processed directly by authorized payment providers under their own terms and privacy notices. We may carry out reasonable authorization, identity, and fraud-prevention checks before accepting or fulfilling an order.

If payment is declined, reversed, unauthorized, or not completed, we may suspend or cancel the affected order. Any cash-on-delivery option, if offered, may be subject to order confirmation, geographical availability, and reasonable limits stated at checkout.

5. Orders and Contract Formation

Submitting an order is an offer to purchase the products shown in your order summary. An automated acknowledgment means that we received your order; it does not necessarily mean that the order has been accepted.

An order is accepted when we send an express order-acceptance or dispatch confirmation, or when we dispatch the products, whichever occurs first. The contract applies only to the products included in that acceptance or dispatch.

We may reject or cancel an order before acceptance for reasonable grounds, including:

• product unavailability;
• an obvious pricing or description error;
• incomplete or failed payment;
• inability to verify essential order information;
• suspected fraud, misuse, or unauthorized resale;
• delivery restrictions; or
• a legal or regulatory requirement.

If we cancel an order after receiving payment, we will refund the amount paid for the cancelled products using the original payment method or another lawful method agreed with you. This does not affect any additional remedy available under mandatory law.

6. Order Information and Customer Responsibilities

You must provide a complete and accurate delivery address, recipient name, telephone number, and any information reasonably required to complete delivery. Please review your order before submitting it and contact us promptly if a correction is needed.

We cannot guarantee that an order can be changed or cancelled after processing or dispatch has begun. Where a delivery failure or additional cost results directly from inaccurate information supplied by you, refusal to accept delivery without lawful reason, or repeated unavailability at the stated address, we may recover reasonable, documented costs to the extent permitted by law and clearly communicated to you.

Orders that appear to be placed primarily for unauthorized resale, fraudulent activity, or abuse of promotions may be limited or cancelled after reasonable review.

7. Shipping and Delivery

Delivery options, estimated timeframes, geographical restrictions, and charges are described at checkout or in our Shipping Policy. Delivery dates are estimates unless we expressly confirm a guaranteed date.

We will take reasonable steps to deliver within the stated timeframe. Delays may occur because of address issues, courier operations, customs procedures, public holidays, weather, emergencies, or other circumstances outside our reasonable control. We will communicate material delays when reasonably possible and provide any remedy required by applicable law.

For international orders, the customer may be responsible for import duties, customs charges, or local taxes not collected by Acacia, where this is clearly disclosed before purchase or required by the destination country's law.

Risk of loss or damage passes to you when the products are delivered to you or to a person you have authorized to receive them. Ownership passes after we receive full payment and the products are delivered, unless applicable law provides otherwise.

8. Returns, Exchanges, and Hygiene-Sensitive Products

Returns, exchanges, refunds, and order cancellations are governed by our Refund Policy and applicable consumer-protection law.

For health and hygiene reasons, underwear cannot be returned or exchanged after its packaging, hygiene seal, or protective wrapping has been removed, or after the product has been worn, tried on, washed, altered, or otherwise made unsuitable for resale. Other sealed hygiene-sensitive products may be subject to the same restriction where permitted by law and clearly identified before purchase.

Whenever possible, please check the product name, color, and size shown on the external packaging before opening it. Removing the packaging may affect your ability to return or exchange underwear for reasons unrelated to a defect or order error.

This hygiene restriction does not remove your legal rights where a product is defective, damaged, unsafe, materially misdescribed, or different from what you ordered. If Acacia sends an incorrect or non-conforming product, contact us promptly and keep the product and packaging available for review. Where required by law, Acacia will repair, replace, accept the return, or refund the product without imposing an unlawful additional cost.

Eligible products that remain unopened, unused, and in their original condition may be returned within the period and subject to the procedure stated in our Refund Policy and applicable law. Proof of purchase and reasonable evidence, such as photographs, may be requested to process a claim, but this will not be used to unreasonably prevent the exercise of a legal right.

9. Promotions, Discount Codes, and Offers

Promotions, bundles, discount codes, gifts, and special offers may be subject to additional terms displayed with the offer. Unless stated otherwise:

• offers are available for a limited period and while stocks last;
• discount codes cannot be exchanged for cash;
• only one discount code may be used per order;
• offers may not be combined; and
• a discount may be withdrawn or an order corrected where the offer was used fraudulently, contrary to its published terms, or because of an obvious technical error.

Any restriction or change will not affect mandatory consumer rights or a completed order already accepted, except as permitted by law.

10. User Reviews, Feedback, and Submissions

If you submit a review, photograph, comment, suggestion, or other content ("User Content"), you retain ownership of your content but grant Acacia a non-exclusive, worldwide, royalty-free license to host, reproduce, display, translate, adapt for formatting, and use it in connection with the Site, Acacia products, customer communications, and reasonable brand promotion. This license lasts only for as long as necessary for those purposes, subject to applicable law and any rights you may have to request removal of personal information.

You confirm that your User Content is accurate to the best of your knowledge, is based on a genuine experience where presented as a review, and does not infringe intellectual-property, privacy, publicity, or other rights. User Content must not be unlawful, fraudulent, defamatory, threatening, discriminatory, obscene, abusive, misleading, or contain malware, undisclosed advertising, or another person's confidential information.

We may moderate or remove User Content where reasonably necessary to comply with law, enforce these Terms, protect another person, prevent fraud, or maintain the integrity of the Site. We are not required to publish every submission.

11. Intellectual Property and Acacia Brand Rights

The Site and its contents—including the Acacia name and logo, product images, graphics, text, page design, videos, labels, icons, and software—are owned by or licensed to [INSERT FULL LEGAL BUSINESS NAME] and are protected to the extent provided by applicable intellectual-property and unfair-competition laws.

Third parties are independent from Acacia unless expressly stated otherwise and may apply their own terms and privacy policies. We do not control and are not responsible for third-party content, security, availability, products, or business practices.

Before purchasing from or sharing information with a third party, review its identity, terms, and privacy practices. Complaints concerning a third party's own products or services should normally be directed to that party. Nothing in this section excludes responsibility that Acacia cannot lawfully exclude.

13. Privacy

Our collection and use of personal information are governed by our Privacy Policy. By using the Services, you acknowledge that you have been given access to that policy. Consent to any processing that legally requires consent will be requested separately where appropriate.

14. Prohibited Uses

You may not use the Site or Services:

We may restrict or terminate access where we reasonably believe these rules have been materially violated, subject to applicable law.

15. Errors, Corrections, and Service Changes

The Site may occasionally contain typographical, pricing, availability, shipping, promotion, or product-description errors. We may correct information and update the Site when reasonably necessary.

If an error affects an order you submitted, we will contact you where appropriate and provide the option to confirm the corrected order or cancel it for a refund. We will not use an error-correction clause to remove rights that arose from an accepted order where the law does not permit us to do so.

We may update, suspend, or discontinue Site features, but this will not affect existing confirmed orders or mandatory customer rights.

16. Service Availability and Product Warranties

We aim to keep the Site secure and available, but we do not guarantee that every digital feature will always be uninterrupted or error-free. We may temporarily suspend access for maintenance, security, updates, or circumstances outside our reasonable control.

Product warranties and remedies are those expressly stated on the Site, included with the product, or required by applicable law. We do not exclude any statutory guarantee concerning product conformity, quality, safety, description, or fitness that cannot lawfully be excluded.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Acacia is not responsible for losses that:

• were not reasonably foreseeable when the contract was formed;
• result from your unlawful use, misuse, or material violation of these Terms;
• arise from inaccurate information supplied by you;
• are caused solely by an independent third party outside Acacia's reasonable control; or
• result from an event outside our reasonable control, subject to any remedy required by law.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, defective or unsafe products, willful misconduct, breach of mandatory consumer rights, or any other liability that cannot legally be excluded or limited.

If you use the Services for commercial or resale purposes without our written authorization, Acacia will not be responsible for business losses such as loss of profit, revenue, business opportunity, or goodwill, to the extent permitted by law.

18. Responsibility for Unlawful Use

You are responsible for reasonably foreseeable losses Acacia suffers because of your intentional unlawful use of the Services, infringement of another person's rights, fraudulent activity, or material breach of these Terms. We will take reasonable steps to reduce avoidable losses and will not seek recovery where prohibited by consumer law.

19. Suspension and Termination

These Terms remain effective while you use the Services. You may stop using the Site at any time. We may suspend or terminate your access where reasonably necessary because of unlawful activity, fraud, a serious security risk, repeated abuse, or a material breach of these Terms.

Termination does not affect rights and obligations that arose before termination, including payment obligations for accepted orders, refund rights, intellectual-property rights, and provisions that by their nature should continue.

20. Events Outside Our Reasonable Control

Acacia will not be responsible for delay or failure caused by events outside our reasonable control, such as natural disasters, severe weather, epidemic, war, civil disturbance, government action, customs interruption, telecommunications failure, major courier disruption, or widespread payment-system failure.

We will take reasonable steps to reduce the effect of such an event and resume performance when reasonably possible. If the event materially prevents us from fulfilling an accepted order, you may have the right to cancel the affected part and receive a refund as required by applicable law.

21. Governing Law and Consumer Complaints

These Terms and contracts made through the Site are governed by the laws of the Arab Republic of Egypt, without depriving a consumer outside Egypt of any mandatory protections that apply in the consumer's country of residence.

Please contact Acacia first if you have a complaint so that we can try to resolve it promptly. Nothing in these Terms prevents you from submitting a complaint to a competent consumer-protection authority or bringing a claim before a court with lawful jurisdiction.

In Egypt, consumer disputes may be submitted to the Egyptian Consumer Protection Agency, which can be contacted through the channels published on its official website.

22. Changes to These Terms

We may update these Terms to reflect changes to the Services, business practices, or legal requirements. The revised Terms will be posted on this page with an updated date.

Changes apply from the stated effective date and do not retroactively alter an order already accepted unless the change is required by law or agreed with you. Your continued use of the Site after the effective date means that the revised Terms will govern your later use of the Services.

23. General Provisions

These Terms, together with the policies and order information incorporated by reference, form the agreement between you and Acacia regarding the Services and relevant purchases.

If any provision is held unlawful or unenforceable, it will be modified or severed only to the extent necessary, and the remaining provisions will continue in effect. A delay or failure to enforce a right does not waive that right.

You may not transfer your rights or obligations under these Terms without our consent, except where applicable law permits. Acacia may transfer its rights or obligations as part of a legitimate business reorganization or sale, provided this does not reduce your mandatory consumer rights.

Headings are included for convenience and do not affect interpretation.

If these Terms are made available in more than one language, all versions are intended to have the same meaning. If a difference arises, the Arabic version will prevail to the extent required by Egyptian law, without limiting mandatory rights applicable to the customer.
